Govt removes five regional power suppliers from list of large privatization facilities

KYIV. Sept 16 (Interfax-Ukraine) – The Cabinet of Ministers has removed five regional power suppliers from the list of large-scale privatization facilities: Ternopiloblenergo, Zaporizhiaoblenergo, Kharkivoblenergo, Mykolaivoblenergo and Khmelnytskoblenergo.

The order, developed by the Ministry of Economy, was adopted by the government at a meeting on Wednesday with a three-day revision with the Ministry of Energy and the National Security and Defense Council (NSDC).

According to First Deputy Energy Minister Yuriy Vlasenko, all the proposals of the Ministry of Energy were not taken into account when developing the draft, and the deadlines for its implementation also require revision.

According to an explanatory note to the draft order, the decision was made in pursuance of the NSDC decision made on July 30, 2021 on measures to neutralize threats in the energy sector (president decree No. 452/2021 dated August 28, 2021).

At the same time, the government instructed the Ministry of Economy, the Ministry of Energy and the State Property Fund to submit proposals for an additional list of state-owned facilities for sale to ensure the receipts from privatization in 2022-2024.

As reported with reference to the draft order, it is proposed to remove the stakes in OJSC Ternopiloblenergo (50.999%), PJSC Zaporizhiaoblenergo (60.2475%), JSC Kharkivoblenergo (65.001%), JSC Mykolaivoblenergo (70%) and JSC Khmelnytskoblenergo (70.0089%) from the list of large privatization facilities approved by government order No. 36-r dated January 16, 2019.

The State Property Fund (SPF), for its part, shall take measures to complete the privatization of non-controlling stakes in three more regional power suppliers – PJSC Cherkasyoblenergo (46%), JSC Sumyoblenergo and JSC DTEK Odesa Grids (25% each).

In addition, JSC Khmelnytskoblenergo, OJSC Ternopiloblenergo, PJSC Zaporizhiaoblenergo, PJSC Cherkasyoblenergo, JSC Mykolaivoblenergo shall ensure the alienation of their shares in the charter capital of electricity supplier companies – Khmelnytskenergozbut, Ternopilenergopostach, Zaporizhiaelectropostachannia, Cherkasyenergozbut and Mykolaiv Electricity Supply Company.

The Ministry of Economy and the State Property Fund shall prepare a draft decision on the transfer of regional power supply companies to the management of the Ministry of Energy, in particular, after the completion of the alienation of suppliers, and submit it to the Cabinet of Ministers.

The order comes into force on April 1, 2022, except for the clauses providing for the alienation of suppliers, as well as the SPF’s obligations regarding additional privatization lists, which take effect from the moment the order is published.
