Ukrainian Agrarian Confederation asks to realize promise of benefits in paying for farmland near war zones
KYIV. April 4 (Interfax-Ukraine) – The Ukrainian Agrarian Confederation called on the Verkhovna Rada to exempt the territories where military operations are possible, as well as those subject to demining, from paying the minimum tax liability and paying for land, by voting for the corresponding changes in draft law No. 7632.
“The land located at a distance of 10-20 kilometers from the border with the Russian Federation and are formally defined as areas of possible hostilities, cannot be properly processed due to constant shelling by the aggressor. Therefore, agricultural production in the territories of possible hostilities is dangerous, and in some cases it is simply impossible,” it said.
The confederation recalled that in November 2021 law No. 1914-IX on ensuring balanced budget revenues was adopted, which introduced minimum tax liability. The first year for which it is charged was 2022, therefore, at the beginning of 2023, Ukrainian farmers submitted the relevant reports and calculations for minimum tax liability.
At the same time, due to the full-scale war, at the beginning of April 2022 law No. 2120-IX for 2022 and 2023 temporarily canceled the accrual and payment of minimum tax liability, in particular, for sites located in the territories where hostilities are/were conducted, in the territories temporarily occupied by the armed formations of the Russian Federation, and/or for land plots identified by the regional military administrations as contaminated with explosive objects and/or on which there are fortifications.
At the end of December 2022, the Ministry of Reintegration by order No. 309 approved a list of territories in which hostilities are/were conducted or temporarily occupied by the Russian Federation. However, the State Tax Service does not take this normative act into account in its work.
As an example, the confederation cites the Bilopillia community of Sumy region, which is included in the list of territories with possible hostilities and is regularly shelled, but farmers cannot use the promised benefits.
At the same time, the confederation added the territory of the Richky village council of Sumy region, located on the border with the Russian Federation, is not included in this list, but also constantly suffers from shelling. As early as 2022, local farmers were forced to abandon agricultural work in the border zone.
