Rada simplifies rules for placement of e-communications facilities for period of martial law
KYIV. Aug 16 (Interfax-Ukraine) – The Verkhovna Rada has simplified the rules for leasing land plots, state-owned and municipal property for the placement of electronic communications facilities for the period of martial law and six months after its termination or cancellation, Oleksandr Fediyenko, Deputy Head of the Parliamentary Committee on Digital Transformation (the Servant of the People faction) has said.
Bill No. 7487 at the second reading was supported by 253 MP at the plenary session on Tuesday.
In particular, the Rada allowed for the duration of the martial law in Ukraine or its individual areas and within six months from the date of its termination or cancellation, the provision of land plots of up to 0.05 hectares for the placement of electronic communications facilities without the consent of the Cabinet of Ministers.
The document also provides for the specified period of the possibility of transferring property for lease on the own initiative of the balance holder, without coordinating such a transfer with the authorized management body in the event that the initiator of the lease of property is an electronic communications operator.
In addition, the bill, for the period of martial law and six months after its termination/cancellation, gives electronic communications operators the right to lease state-owned and municipal property (as well as to extend its lease agreements) without holding an auction – for the placement of technical means and/or electronic communications structures.
In addition, lessors undertake to adhere to uniform technical conditions for access to the entire list of infrastructure elements of the access facility specified by the customer.
In case of destruction of the infrastructure of the access facility or the technical means of electronic communications located at the access facility due to hostilities, the specified access agreement is terminated upon a written request of one of the parties.
