NSDC makes changes to personal sanctions against Yanukovych, Lebedev, Kurchenko and Deripaska

KYIV. Oct 12 (Interfax-Ukraine) – President of Ukraine Volodymyr Zelensky has signed a decree on the implementation of the decision of the National Security and Defense Council of Ukraine (NSDC) dated October 12, which amends personal sanctions against a number of individuals.

Corresponding decree No. 694/2022 was published on the President’s website.

According to the text of the decision, the NSDC supported the proposals made by the Cabinet of Ministers on the application and amendment of personal special economic restrictive measures imposed against former President of Ukraine Viktor Yanukovych, ex-Minister of Defense of Ukraine Pavlo Lebedev, Ukrainian entrepreneur Serhiy Kurchenko and Russian businessman Oleg Deripaska.

The new sanctions imply the blocking of the assets of these persons – namely, the temporary deprivation of the right to use and dispose of assets belonging to them, as well as assets in respect of which they can directly or indirectly (through other individuals or legal entities) perform actions identical in content to the exercise of the right to dispose of them.

The sanctions are set for a period of 10 years.

Previously, the sanctions imposed against Yanukovych, Lebedev, Kurchenko and Deripaska assumed only a restriction on the right to use property directly belonging to them. The restriction was set indefinitely.

Other sanctions imposed indefinitely by the NSDC decisions of March 19, 2021 and June 18, 2021 remain in force.

These sanctions include restriction of trade operations, termination of fulfillment of economic and financial obligations, restriction, partial or complete termination of transit of resources, flights and transportation on the territory of Ukraine, as well as a complete ban on the entry of foreign non-military vessels and warships into the territorial sea of Ukraine, its internal waters and ports. It provides for measures aimed at preventing the withdrawal of capital outside Ukraine, the termination of the issuance of permits, licenses for the import into Ukraine from a foreign state or the export of currency values from Ukraine and the restriction of the issuance of cash on payment cards issued by residents of a foreign state. A ban has been imposed on the transfer of technologies and intellectual property rights, the cancellation or suspension of licenses and other permits, the availability of which is a condition for carrying out a certain type of activity (in particular, the cancellation or suspension of special permits for the use of mineral resources), the prohibition of issuing permits, licenses of the National Bank for investments in a foreign state, placement currency values on accounts and deposits in the territory of a foreign state and the prohibition of participation in privatization, lease of state property.

The restrictions also provide for the deprivation of state awards of Ukraine and other sanctions that comply with the principles of their application established by current legislation (deprivation of military ranks, special ranks, class ranks).
