MPs want to increase fines for encroachment of land
KYIV. Oct 5 (Interfax-Ukraine) – To bring administrative responsibility for encroachment of land to the existing economic realities, a number of MPs propose to increase the fine for unauthorized takeover of a land plot from the current UAH 170-850 to UAH 34,000-102,000 for individuals and UAH 340-1,700 to UAH 68,000-170,000 for officials.
Bill No. 6124 was registered on October 1 in the Verkhovna Rada by seven MPs from the Servant of the People parliamentary faction and the Dovira parliamentary group.
The document also proposes to increase the amount of fines for the use of land not for its intended purpose, namely, for failure to comply with the environmental regime of land use, placement, design, construction, commissioning of facilities that negatively affect the state of land, improper operation, destruction or damage of anti-erosion hydraulic structures, and protective afforestation.
The MPs proposed to increase the fine for these administrative offenses from the current UAH 85-425 to UAH 17,000-51,000 for individuals and from UAH 255-510 to UAH 85,000-119,000 for officials.
According to the bill, administrative liability for the use of land for other purposes is not applied in the case of the use of degraded and unproductive lands by the offender, as well as those in need of conservation and intended for afforestation.
According to an explanatory note to the document, amendments to the Code of Administrative Offenses regarding the increase in fines for these violations of legislation were introduced back in 2007-2008. Since then, social and economic conditions in Ukraine have changed significantly, but these fines have remained unchanged.
