Justice Ministry approves writing off UAH 78 mln of Donetsk Railway debts from Ukrzaliznytsia despite moratorium – Leshchenko
KYIV. Sept 10 (Interfax-Ukraine) – JSC Ukrzaliznytsia, despite the previously imposed moratorium, is forced to pay the debts of the branches remaining in the occupied territories, member of the Ukrzaliznytsia supervisory board Serhiy Leshchenko wrote on his Telegram channel on Friday.
"Ukrzaliznytsia is being deprived of almost half a billion hryvnia. This is done in the silence of offices and in spite of the moratorium on the recovery of Ukrzaliznytsia’s assets under the obligations of those branches that remained in the occupied territories. In particular, on the obligations of the Donetsk Railway until the end of the ATO," he wrote.
According to Leshchenko, on September 9, 2021, Ukrzaliznytsia was deprived of UAH 78 million in the claims of Donbasenergo – the executive service of the Ministry of Justice opened enforcement proceedings and the money was debited from the company’s account.
"On the way – another $13.5 million will be written off, that is, more than UAH 360 million under the claims of the Investohills company. That is, all anti-crisis measures taken by Ukrzaliznytsia to fill the company with money end in the fact that this money is written off on the Donetsk Railway’s debts despite the moratorium. Ukrzaliznytsia filed an application for suspension of enforcement actions on the basis of a legal moratorium. But so far the application has not been satisfied. And, accordingly, enforcement proceedings have not been stopped," Leshchenko said.
According to him, due to the inaction of Justice Ministry officials, there is a risk of unlawful collection from Ukrzaliznytsia of almost UAH 0.5 billion, of which UAH 78 million has already withdrawn from the company’s accounts.
"The Management Board and Supervisory Board of Ukrzaliznytsia are trying to save the company’s money to the last, and therefore they demand from the Ministry of Justice to urgently stop sending requests to write off money, and from the Prosecutor General’s Office – to impose a ban through the court on any write-offs and seizure of Ukrzaliznytsia’s property based on episodes of the Donetsk Railway," Leshchenko said.
