AMCU again allows Smart Holding to buy 29.8% of Kharkivoblenergo shares
KYIV. Oct 28 (Interfax-Ukraine) – The Antimonopoly Committee of Ukraine (AMCU) has again allowed Smart Holding (Cyprus) Ltd. to buy over 25% in JSC Kharkivoblenergo, the committee’s press service said on Thursday.
According to it, the new application for the concentration from Smart Holding was considered in the mode of an unfriendly acquisition, since Kharkivoblenergo did not provide the Cypriot company with the information necessary to consider the application for preliminary obtaining permission for the concentration.
In this regard, by the order of the authorized government official, the necessary information was requested from Kharkivoblenergo.
"During the consideration of the application, the committee found that this concentration does not lead to monopolization or significant restriction of competition in the commodity markets and has provided the appropriate permission," according to the statement.
